Publishing & Entertainment
Bardacke Allison Miller lawyers have expertise in every aspect of book publishing. We represent both authors and publishers in print, ebook, and audiobook publishing agreements, motion picture and television options, collaborative efforts among multiple authors, clearance of rights owned by third parties, and infringement, defamation, and publishing disputes. We advise and assist authors and literary estates in securing trademark rights where appropriate. We have also assisted clients in placement of their literary, photography, or artistic archives with major American museums on both coasts as well as in New Mexico. We advise both celebrities and others on rights of publicity and privacy.
We also represent motion picture producers, writers, and talent in entertainment transactions, and have assisted recently in both domestic and overseas television and motion picture rights acquisitions.
When the rights of our clients are being misused in print or other media we can move quickly to get emergency help from courts. In 2015 Mr. Allison won a preliminary injunction in federal court on behalf of Harvard University involving an infringing book. Also in 2015 he filed suit against Penguin Random House and an author for copyright infringement and secured a successful resolution before reaching the preliminary injunction stage.
